1. Warranty period and scope of use

SINGULARWOD Spain S.L. offers a commercial guarantee about its products, in the following terms and without prejudice to the legal guarantee of conformity provided for in current regulations:

• Private use: additional commercial guarantee of 2 years from the date of delivery of the merchandise.
• Facilities for public or professional use: commercial guarantee of 1 year from the date of delivery of the merchandise.

This warranty covers manufacturing defects, provided that the conditions of use, proper maintenance and applicable regulations are respected.

The delivery date will be confirmed by a delivery note signed by the buyer. Said document and/or proof of purchase, receipt, transport document and/or invoice must be presented to personnel authorized by SINGULARWOD Spain S.L.

2. Applicable legal framework

In accordance with current regulations on the protection of consumers and users, in particular the Royal Decree-Law 7/2021, which transposes the Directive (EU) 2019/771, the following minimum legal guarantees are established, applicable exclusively to consumers:

• New goods: minimum legal guarantee of 3 years.
• Second-hand goods: minimum legal guarantee of 1 year.

Definition of consumer (summary):

• Natural person who acts for purposes other than their commercial, business, trade or profession.
• Those who acquire goods or services to integrate them into production, transformation, marketing or provision processes to third parties are excluded from this definition.

In no case will these commercial guarantee conditions limit, exclude or replace the rights recognized to the consumer by the applicable legal regulations.

3. Warranty coverage

SINGULARWOD Spain S.L. guarantees that its products are free from defects in material and manufacturing.

For the guarantee to be valid, it will be necessary that the total amount of the contract has been paid.

The warranty covers the free repair or replacement of the product or those components that are recognized as defective due to manufacturing defects, at the discretion of the authorized technical service.

4. Warranty Exclusions

The following are expressly excluded from the guarantee, in any case:

• Damage resulting from accidents, misuse, negligence, lack of maintenance or unauthorized repairs.
• Use not in accordance with the product instructions.
• Connections, modifications or maintenance carried out by unauthorized personnel.
• Incorrect installation, improper assembly or use of unsuitable consumables.
• Defects not attributable to manufacturing failures of the product or its materials.
• Voltage drops or fluctuations in the facilities where the equipment is located.
• Damage caused by placing electronic products in humid environments or with sudden changes in temperature.

Parts and elements subject to wear

Parts that, due to their nature or use, are subject to wear and tear, such as:

• Cables, straps, treadmill covers.
• Embedded materials, transmitters or other consumables.
• Glass, lights, bulbs and similar elements.

The effects derived from normal use, wear or aging of the product are also not covered.

5. Procedure and associated costs

When the defective parts are not sent to the workshop SINGULARWOD Spain S.L., the travel costs of technical personnel will be borne by the client.

Once the commercial guarantee period indicated in the General Conditions of Sale has ended, any technical intervention will be invoiced according to the current rates, including, where applicable:

• Replaced components.
• Labour.
• Displacement of technical personnel.
• Transportation of materials.

6. Authorized technical service

SINGULARWOD Spain S.L. will not assume any responsibility for defects or damage resulting from repairs or attempted repairs carried out by unauthorized personnel or technical services.

The client must always contact the official technical service of SINGULARWOD Spain S.L. Any intervention by an unofficial technical service will automatically result in the loss of the commercial warranty.

7. Liability and limitations

To the extent permitted by applicable law, SINGULARWOD Spain S.L. will not be responsible for direct or indirect damages to people, property or animals resulting from non-compliance with the installation, use or maintenance instructions indicated in manuals, brochures or product catalogues.

Except for mandatory legal provisions, the client will not have the right to compensation for indirect damages, lost profits or inability to use the product, nor will compensation be assumed against third parties.
